Just when you thought it couldn’t get messier, the Activision Blizzard lawsuit delivers. With the company experiencing grief on multiple fronts in the forms of various lawsuits, the last thing one would expect is to see two of those assailants going after each other. Both of which are governmental bodies, no less. So strap in, because the lawsuit just went PvPvP.

As we attempt to bypass the legal jargon, we’ll summarise all the allegations that have emerged over the last week:

  • AB and the federal Equal Employment Opportunity Commission (EEOC) reached a $18 million settlement.

  • The State of California Department of Fair Employment and Housing (DFEH) - who are filing a different yet similar lawsuit against AB - have attempted to put a stop to these proceedings by filing an expedited intervention.

  • This is because DFEH is concerned that it could do “irreparable harm” to their own investigation since it would lead to the “effective destruction” of evidence that their case relies upon.

  • The EEOC then filed an opposition against the intervention. Alleging that two lawyers in the DFEH intervention were former EEOC employees that had even worked on the EEOC’s investigation of AB.

  • If true, this means that the two lawyers who helped orchestrate the EEOC settlement are now objecting to it through the DFEH.

  • This chaotic move may now potentially violate one of California’s Rules of Professional Conduct. As well as constitute a conflict of interest.

Confused? So are we. But just know this: if all of the above is as the EEOC’s memorandum describes - then the entire DFEH lawsuit could be compromised. Meaning Activision Blizzard may come out of this smelling of roses. So long as you discount the relatively menial settlement cost and substantial reputational damage.

If so - then it’s all eyes on ABetterABK as they continue to fight for the workers of Activision Blizzard. And here’s hoping they get the resolution they deserve.
